If they were fined for paying by the hour, would that not mean they were fined for treating employees like subs? Then there would be other fines as well like taxes unpaided ss contributions and such.

There is a list of what a sub is considered to be from our AG office.

The 1099 thing is way abused here on the Cape. But they get away with it unless there is a complaint filed, and you don't here to much about any of that going on here. Not uncommon for guys around here to work as employees for years, but paid 1099 .
