I am looking for a good contract agreement form, I have used this one quite a bit.

What do you guys think of it? I kind of don't like the idea of penalty, sometimes you can't finish work cause of the contractors that are building the house but it can be changed however you'd like.

There are to many bad clauses for you in that contract. Ours vary from job to job with some wording changes. We had our lawyer draw ours up and we fine tune it from there.
Every job is different, weather can cause delays and push the completion date back on exteriors so $100 a day is unrealistic in my mind especially for a contractor. Interiors depending on if it's for a HO or GC delays can and will happen.

I totally agree on that, painting has a lot of delays, if carpenters don't finish their job or trim isn't finished, and so on. Maybe I will get a lawyer to make me a good one. Thanks for your guys opinions!

We looked on the internet for some and said screw it got our lawyer to draft one. If you have a lawyer draft one don't be afraid to have him/her add or remove wording. Make ut so it works for your particular company.

As dumb as this sounds, even the best worded contract will not get you paid if working for the wrong person. I always have a bid. I never get them signed. Larger contracts, im signing someone else's contract with my numbers and scope of work. Smaller stuff, I email them always because email is as good as a written signature. Hard part of speaking legalese to a homeowner they wonder what your angle is. I have yet to see my pest control guy, hvac guy and anyone else I hire try and hit me with multiple paragraphs of legal mumbo jumbo. My contract says my pay out scale and I dont work if I dont get paid. Simple.

You're right on the mark about contracts not saving you. As I've said for years, with good clients, you don't need a contract; with bad clients, the best contract won't save you.

We rarely have a signed contract these days, but we do have the client sign a legal notice required by our state about lien rights, etc.

Yeah agree, we rarely do any contracts either, with the same and good clients never needed a contract, but for bad ehh you never know
