It is my understanding as a sole propriotor I am not required by law to carry workers comp. My brother and I both paint together but we carry our own liability. Once in a while if a contractor requires a workers comp policy we will get a ghost policy. My brother used to be incorperated and would get a workers comp audit yearly. I would work for him as a sub and when checks are written to subs (me) and they could not provide a work comp policy the incorporation would have to pay $10 per $100 earned by that sub. My brother and I would like to keep our businesses as simple as possible. My job, he works for me and I 1099 him. His job he 1099's me. It may sound silly to do it this way but we are both career firefighters and paint around 30 hours a week, the simpler the better. Do i need workers comp for myself.

If you fall off a latter while painting will your current job or insurance support you when you can't fight fires? If no then either get the WC or get a Disability Ins.

I think it depends on the state. $10,400 is the minimum salary as the owner/only officer of the company. I think the rate for painters in Mass is 6.85 per 100. You brother should still be paying comp on you even as a 1099 unless you have given him a comp policy.

The town I live in has some part time firefighters. I hope they dont make them fight fires without hoses.

It's gone down here this year to 4.79%, and I think there is talk of reducing it more. I'll know more after Tuesday when an expert will be addressing our NGPP chapter meeting. And the minimum premium will be $2299, which is based on something like a $38,000 salary PLUS $500 for "terrorist" coverage. (or some such BS)

As stated, each states WC laws are vastly different. Where do you live? If you are in Mass, I could offer you some help. Otherwise I would either call a KNOWLEDGEABLE agent or search your state's WC info on the internet.
